Requirements For Towing Companies

  • All tow companies will sign the Latah County Sheriff’s Office towing agreement before being placed on the tow rotation. Failure to comply with the terms of this agreement may result in the removal of the tow company from the tow rotation list
  • All companies on the County tow rotation list shall have a secure storage yard in Latah County. Towed vehicle will be taken to this storage yard unless otherwise requested by vehicle owner or the Deputy in charge of the scene
  • The towing rotation will be calling the tow companies on the list in succession
  • A separate tow rotation will be used for abandoned vehicles
  • All tow companies will be available for tows on a twenty four hour basis, seven (7) days a week
  • Vehicle owners shall have access to retrieve their vehicles during regular business hours (0900 hours to 1700 hours)
  • The tow company must notify the Latah County Sheriff’s Office when impounded vehicles are released to the owner
  • All tow companies are expected to respond to a call within a reasonable time frame. If the wrecker service called is unable to respond in a timely manner, it will be the on-scene Deputy’s decision to determine either to use the next tow company on the rotation list or accept the delay in response
  • All tow companies will furnish proof of liability insurance to the Latah County Sheriff’s Office before being placed on the tow list
  • The tow company called to a scene will be responsible for cleaning up and hauling away all accident caused debris at the scene
  • A tow company representative will be responsible for providing both the tow fees and daily storage fees to the Deputy while on scene
  • In cases where specialized equipment is necessary, the Latah County Sheriff’s Office may deviate from the rotation list to obtain such specialized equipment
  • Tow companies must continue to meet the requirements of this agreement in order to remain on the rotation list
  • The Latah County Sheriff’s Office reserves the right to inspect storage yards and review insurance policies to confirm tow companies are in compliance with this agreement
  • Tow companies are required to submit a current list of qualified drivers to the Latah County Sheriff’s Office. Driver’s license numbers shall be included
  • Vehicle owner information obtained from the Latah County Sheriff’s Office shall not be used for any purpose other than notification of the impoundment
  • INDEMNIFICATION: Towing Operator shall defend, indemnify, and hold the County, its officers, agents, and employees harmless for all claims, losses, actions, damages, judgments, costs, expenses, and/or injuries to persons or property arising out of or in connection with any activities, acts, or omissions of Towing Operator, its officers, agents or employees. In the event County is alleged to be liable on account of any activities, acts, or omissions of Towing Operator, its officers, agents or employees, then Towing Operator shall defend such allegations through counsel chosen by County, and Towing Operator shall bear all costs, fees, and expenses of such defense, including, but not limited to, all attorney fees and expenses, court costs, and expert witness fees and expenses
  • RELATIONSHIP OF PARTIES: This Agreement does not vest any legal right in Towing Operator to continued placement on the LCSO Tow Rotation List, Towing Operators are added and removed from the Rotation List at the discretion of the Sheriff. Towing Operator is not an employee of LCSO or Latah County."
